CHENNAI: A senior IPS officer with the rank of Inspector General, who obtained a compensation order of 1 crore rupees in the Madras District Court against three journalists, an editor and an editor of a daily, in damages, has now asked the court to direct their current organization to embezzle their salaries because they have no way to pay the compensation.
On February 18, 2020, Judge M Sundar passed the decree in favor of Pramodkumar, which had dragged O Thomas, printer and publisher of Deccan Chronicle and Holdings Limited, AT Jayanthi, editor of the daily, VP Raghu, Vidyashree Dharmaraj, Pradeep Damodaran, then reporters for the daily, for having published slanderous press articles against him.
Now, Pramodkumar has filed an application for execution in the High Court. Admitting the plea, a High Court Magistrate’s Court ordered that a notice be returned in two weeks.
The issue concerns a civil action for damages brought by Pramodkumar in 2010 claiming 1 crore rupees in damages against the daily and journalists for allegedly publishing defamatory press articles against him.
The defendants filed a joint affidavit that the publications were made in the public interest and that the material was already available in the public domain in other legal proceedings. They were not subsequently represented in the trial.
Therefore, finding that the defendants had failed to discharge the charge or position they had taken by way of the joint affidavit, the court made an ex parte order in favor of the agent of the ‘IPS.
